A sworn translation is a certified translation made official by an oath report, completed and signed by the professional translator. The oath report is attached to the translation, stamped, validated and registered by the Public Official (Registrar) at the Asseverations Office of the Court (or by a notary public or at the consulate of the country of destination). By its nature as an act produced by a judicial body, it has legal value.

Certified translations, on the other hand, are accompanied by a Certification of Translation Accuracy, i.e. a certificate of accuracy of the translation issued by the translator or translation agency itself, usually drawn up in the target language and bearing the stamp, signature and data of the professional translator. The certificate of accuracy therefore certifies the translator’s linguistic competence and the authenticity of the translation.
SWORN TRANSLATION WHAT IT IS?
When talking about sworn translations, reference is made to a particular type of translation that is necessary for documents that must retain their legal value. The affidavit can be made in front of a notary, in front of a judge of the peace or in court, a task that the translation agency usually performs.
A certified translation may be necessary for several documents and, once the legal document has been translated, the translator is required to take an oath by which he declares that he has respected the original content and has not altered it, translating without defects of form, without omissions and without ulterior motives.
This oath is then recorded in the minutes. The oath report shall then be delivered to the registry of the relevant court together with the translation and the translated document. In the court all the stamps of the case are affixed, but the sworn translation assumes legal value only after the double signature of the clerk of the court and the translator. In addition, a stamp worth 16 euros per hundred lines of the package is required.
A certified translation is required whenever any body or institution, company or private citizen needs to present an official document. There are many documents that may require a sworn translation: from family documents (marriage or divorce certificate, birth certificate) to court documents, from wills to proxies, and so on.
Therefore, it can be deduced that the sworn translation has a real legal value, which is conferred on it by the legal procedure that derives from the oath. In Italy there is no provision for the possibility of swearing translations relating to two foreign languages. For example, if you have to sworn a translation from Spanish into English, you must first translate from Spanish into Italian, then translate from Italian into English; this obviously requires two oaths. These are lengthy and uninviting bureaucratic procedures, which is one of the reasons why it is preferable to contact specialised translation agencies such as ours.
